New York State Department of Agriculture and Markets Orders NYC to Drop Foie Gras Sales Ban

Hudson Valley duck farmers, organized as the Catskill Foie Gras Collective, announced today that the New York State Department of Agriculture and Markets has ruled that NYC’s proposed ban on the sale of foie gras in NYC restaurants and retail stores violates State law. The Department has issued an Order directing that New York City “immediately comply with the provisions of Section 305-a of the Agriculture and Markets Law” and refrain from taking any action “that would restrict [the farmers’] ability to sell their product in the New York City market.” Agriculture and Markets Law § 305-a prohibits municipalities, like New York City, from enacting laws that unreasonably restrict farming operations in certified agricultural districts. The Hudson Valley duck farms are located within certified agricultural districts. The Department issued its Order after investigating the farmers’ complaint that NYC’s sales ban, which is known as Local Law 202, would unreasonably restrict their operations. “After reviewing our complaint, the Department of Agriculture has determined the City’s proposed actions do, in fact, violate New York State Law,” said Marcus Henley, a spokesperson for the Catskill Foie Gras Collective. “We are extremely grateful that the Department has taken this action, as hundreds of Sullivan County farm worker jobs were hanging in the balance.” Local Law 202 would have become effective on November 25, 2022, but in a separate lawsuit, a Manhattan judge issued a preliminary injunction that enjoins the City from enforcing the law pending further proceedings in that suit. Had Local Law 202 gone into effect at that time, the sales ban would have caused millions of dollars in revenue loss to the State, New York City, restaurants, wholesale distributors, retail store owners, and related transportation companies. “On a broader scale, the order stops local municipalities from establishing a dangerous precedent of dictating to us what farmers can grow and what people can eat,” added Henley. “It’s great news for farmers and fine diners everywhere.” Proponents for the sales ban, including animal rights groups, mistakenly claim that ducks are treated inhumanely during the foie gras production process. Hudson Valley Foie Gras and La Belle Farms respond that their ducks are well cared for, are allowed to roam freely, and are processed in a government-inspected facility, strictly adhering to animal welfare and federal regulations. Both farms produce foie gras using a special hand-feeding method, like no other farm in the world, so as not to harm the ducks. “These well-funded groups are reactionary and powerful, often times acting without knowing all the facts,” said Sergio Saravia, President of La Belle Farms. “We welcome politicians and reporters to visit our poultry farms and see, firsthand, the farming practices we have in place.” New York City has thirty days to challenge the Department’s Order by filing a court proceeding in Albany County. “We hope the City will accept the Order given the Department’s authority and expertise enforcing the Agriculture and Markets Law, but we will continue to fight to protect our farms if the City decides to spend even more taxpayer dollars on taking the matter to court in Albany.” For more information about foie gras production visit: https://foiegrasfacts.org. Murgado Automotive Group CEO Mario Murgado today announced the acquisition of Honda and Acura dealerships from Pauly Motors, Inc. in North Chicago. The renamed Honda Libertyville and Acura Highland Park represent Murgado’s second expansion into the Greater Chicago market as his dealership group purchased Honda of Downtown Chicago and Volkswagen of Downtown Chicago in 2017. Both have grown into top-performing dealerships. Murgado Automotive Group now represents 18 dealer franchises in Miami, Chicago, and New Jersey. The sale closed on December 5, 2022. Pauly Motors has a rich history in the area, opening and successfully operating one of the first Honda motorcycle stores in the area and later opening one of the first Honda dealerships in Chicago. The organization expanded to other brands, including Acura, and has an excellent reputation in the industry. Honda of Libertyville and Acura Highland Park are now open to the public and have already sold and serviced their first vehicles under the new ownership. Minimal staffing changes were announced. Murgado said he is grateful for the opportunity to acquire the dealerships and is optimistic that he and his team will grow the business with the assistance of many of the wonderful, long-time employees of the dealerships. He said that Murgado Automotive Group will be making a large investment in both dealerships, including sales, service, parts, and other departments. Cleantech Oxyle powers wastewater treatment as it raises $3 million to scale growth

Water contaminated with persistent and toxic pollutants is one of the world’s most pressing health and environmental concerns. All over the world precious bodies of water are contaminated with micropollutants such as pesticides, pharmaceuticals, and PFAS chemicals. When untreated, these chemicals cause hormonal imbalances, cancer, and birth defects in humans and pose a serious threat to the survival of our ecosystems. In addressing this global crisis, Oxyle AG, an advanced wastewater treatment and monitoring solution provider, is today announcing a $3 million pre-seed funding round to bring to market their mission of improving the health of our precious bodies of water and protecting ecosystems against micropollutants. The funding round was led by Wingman Ventures with participation from SOSV, Better Ventures, and another.vc. Including this round, with pre-seed non-dilutive funds and grants raised last year, Oxyle has raised over $7.4 million in total. Founded in 2020, Oxyle has developed a sustainable and scalable technology that destroys a wide range of micropollutants including the forever chemicals such as PFAS, pharmaceuticals, hormones, pesticides etc. from contaminated wastewater. Oxyle’s novel treatment process is driven by their nanoporous catalysts that oxidise and eliminate micropollutants, down to detection limits of 1 ng/L, even for the highly persistent compounds that are resistant to existing treatments. This treatment process is coupled with Oxyle’s proprietary analytics technology that allows for real-time monitoring of micropollutants, a truly unique and much-needed offering that helps customers comply with their strict discharge regulations. The aim is to install remotely operated modular, decentralised reactors of varying sizes to meet customer needs from chemical industries, pharmaceutical companies, hospitals, and environmental remediation projects. The core technology behind this game changing innovation was developed over 5 years by Oxyle’s CEO and co-founder, Dr. Fajer Mushtaq, during her doctoral research at ETH Zurich that commenced in 2014. Together with Dr. Silvan Staufert, the concept of a novel catalyst for micropollutant degradation was built into a scalable technology platform that is able to address the problem where it matters: at the source, before they enter waterways. Oxyle has successfully completed several paid pilots with industrial and municipal customers, advanced its technology to TRL8 through on-site demonstrations, and grown to a team of 17 people. At present, 80% of the world's wastewater is discharged in rivers, lakes and groundwater bodies without receiving any treatment. In the last few years, incredible advances have been made in the field of water analysis allowing regulators to detect very low concentrations of pollutants in water. Moreover, regulators now have a much better understanding of how toxic and problematic even very low concentrations of micropollutants are for humans and our ecosystems. Just this year, EPA’s health advisory level for PFOA (chemical used in the production of waterproof clothes, teflon, cosmetics etc.) was drastically lowered from 400 ppt (ng/L) in 2009 to 0.004 ppq (pg/L), a 100,000x stricter level due to the danger these chemicals pose to humans when consumed. These market drivers and the lack of effective solutions, have created the perfect opportunity for Oxyle to bring our innovative treatment and monitoring solution to market and fill the much needed void. The proceeds from the funds raised in our round will be used to strengthen our team with upscaling capacities, expand our customer portfolio into attractive market segments, build partnerships to enter new locations, and most importantly, to bring our first product to market next year.
